A Lahore anti-terrorism court has approved a 21-day physical remand for Hammad Azhar, a leader of the Pakistan Tehreek-e-Insaf (PTI), in connection with the attack on Jinnah House during the May 9 disturbances. This decision follows a petition filed by Azhar’s mother in the Lahore High Court seeking his recovery.
Legal Proceedings and Police Actions
The Lahore High Court received a habeas corpus petition from Azhar’s mother, asserting that her son had been detained on Saturday, though police in Lahore and Multan initially denied knowledge of his arrest. It wasn’t until Monday that Azhar was brought before the court amid heavy security by the Sarwar Road police.
The charges against Azhar and several PTI members stem from their alleged involvement in the attack on Jinnah House, which also serves as the corps commander’s residence. This incident occurred during protests against the arrest of former Prime Minister Imran Khan.
During the court session, the police requested a 60-day remand, arguing that Azhar had been elusive for a significant period and was only recently apprehended. They sought his remand to facilitate interrogation and investigate his alleged role in the conspiracy.
Defense Arguments and Court Observations
Barrister Abuzar Salman Niazi, representing Azhar, challenged the police’s claims, arguing that no evidence had been gathered during the alleged three-year period Azhar was in hiding. The defense criticized the police for not conducting an identification parade and for presenting Azhar with his face covered.
The court advised the police to ensure Azhar’s appropriate treatment, emphasizing the importance of dignity in handling suspects. The defense also highlighted similarities with another case involving PTI leader Dr. Yasmin Rashid, who had been discharged based on a similar co-suspect’s statement.
After considering both sides, the court granted a 21-day remand, allowing the police to proceed with their investigation.
Family’s Legal Efforts and Political Reactions
In response to Azhar’s arrest, his mother, Ishrat Azhar, moved the Lahore High Court. Her petition named several police officials as respondents, alleging that Azhar’s detention was illegal and lacked a lawful basis. The petition urged the court to ensure Azhar’s access to legal representation and contact with his family.
Azhar, the son of a former Punjab governor, has been declared a proclaimed offender by various courts for not appearing in proceedings related to the May 9 incidents. Despite reports and social media claims about his custody, local police officials initially denied confirmation of his arrest.
The PTI has condemned Azhar’s arrest as politically motivated, accusing the government of using state resources to target political adversaries. Azhar had re-emerged publicly in May 2024, after having gone into hiding following the state’s crackdown on party leaders.
